BOARD OF ADJUSTMENT MEETING
June 26, 2005
After being elected Acting Chairman, Bob Burden called the meeting to order at 4:06 p.m. in the Town Hall.
Board members present were: Bob Burden, Charlotte Sterk, Michael Chaput, and Chris Hallman. Member Cheryl Dergins was absent.
The Board considered the following item:
•1. Request for a variance to the setback requirements for the block known as Village Green: Katherine Hopkins Druckman and Geri Druckman were present to represent the item. Burden asked if any of the citizens present had comments. Audrey Mallette stated that she objected to granting a variance after the fact. Poncho Howse stated that there should be consequences for the way the situation was handled and that there is a question of equity. Barnell Albers, chairman of the Architectural Review Board, urged the Board not to grant the variance, and he explained the actions taken by the ARB. Jackie Anderson stated that she did not agree with the variance being granted. Scotty Lynch stated that Texas Pioneer Arts Foundation will take responsibility for moving the buildings. Katherine Druckman stated that the reason for requesting the variance is to get her objections to the ARB ruling on the record. She went on to say that the ARB did not have the authority to declare the four lots that make up the block as one lot; and that the determination that the Wantke Street side was the backyard was erroneous, since some of the buildings have addresses on streets other than Bauer-Rummel Road. Sterk asked whether one of the buildings was to be removed or just moved. Albers answered that the buildings were to be moved. Hallman pointed out that the only issue under consideration was the request for variances from the setback requirements. Mrs. Druckman stated that the issue of whether the block is considered as one lot, instead of four, directly affects the setbacks. After further discussion of the aesthetics of the placement of the buildings, there was a motion by Burden that the request for a five-foot variance of the setback required for the house on White Street be denied; second by Hallman. Motion carried with all in favor. Motion by Hallman that the request for a ten-foot variance of the setback on Wantke Street be tabled and that the issue of whether the block should be considered as one lot or as four lots be reconsidered by the Architectural Review Board; second by Chaput. Motion passed with all in favor.
